1. Introduction

5. User Conduct and Content

5.1 User Content

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:

• Your User Content does not contain libelous or otherwise unlawful, abusive, or obscene material

• Infringes any patent, trademark, trade secret, copyright, or other intellectual property or proprietary rights of any party

5.4 Content Removal

PerspectiveHub reserves the right, but not the obligation, to monitor, review, and remove any User Content that violates these Terms or that we find, in our sole discretion, to be otherwise objectionable, without prior notice.

6. Intellectual Property Rights

6.1 PerspectiveHub Content

The Services and all content, features, and functionality thereof, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the design, selection, and arrangement thereof (collectively, "PerspectiveHub Content"), are owned by PerspectiveHub, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 Trademarks

The PerspectiveHub name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PerspectiveHub or its affiliates or licensors. You may not use such marks without the prior written permission of PerspectiveHub. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

6.3 License Restrictions

These Terms do not grant you any rights to use the PerspectiveHub Content except as necessary to use the Services as permitted by these Terms. You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the PerspectiveHub Content, except as permitted by these Terms
• Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Services
• Use any PerspectiveHub Content for commercial purposes

TO THE FULLEST EXTENT PERMITTED BY LAW, PerspectiveHub DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PerspectiveHub DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. PerspectiveHub DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF THE SERVICES OR ANY CONTENT OR MATERIALS ON THE SERVICES.

7.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PerspectiveHub, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
• ANY CONTENT OBTAINED FROM THE SERVICES
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL PerspectiveHub'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

7.3 Indemnification

You agree to defend, indemnify, and hold harmless PerspectiveHub, its affiliates, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

8. Termination

PerspectiveHub may terminate or suspend your access to all or part of the Services, without notice, for any conduct that PerspectiveHub, in its sole discretion, believes violates these Terms or is harmful to other users of the Services, PerspectiveHub, or third parties, or for any other reason.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Changes to Terms

10. Governing Law and Dispute Resolution

Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. The arbitrator shall award to the prevailing party, if any, the costs and attorneys' fees reasonably incurred by the prevailing party in connection with the arbitration.

Notwithstanding the foregoing, PerspectiveHub may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

12. Waiver

No waiver by PerspectiveHub of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of PerspectiveHub to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

13. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by PerspectiveHub on the Services, shall constitute the entire agreement between you and PerspectiveHub concerning the Services.
